Terms of Service

Effective date: September 4, 2026

Please read these Terms carefully. They include a binding arbitration provision and class action waiver (Section 16), a limitation of our liability (Section 14), and important disclaimers about food safety and allergens (Section 8). By creating an account, placing an order, or otherwise using MealDay, you agree to these Terms.

1. Agreement to These Terms

These Terms of Service (the “Terms”) are a binding agreement between you and Jordan Rabidou, doing business as MealDay (“MealDay,” “we,” “us,” or “our”), the operator of the MealDay platform available at mealday.app and at organization-branded addresses powered by MealDay (collectively, the “Service”). By accessing or using the Service you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. What MealDay Is — and Is Not

MealDay is a software platform only. We provide technology that lets independent organizations — such as camps, schools, and similar programs (each an “Organization”) — publish menus, accept meal orders from parents and guardians, and organize kitchen and reporting workflows.

  • MealDay does not prepare, cook, package, label, inspect, store, transport, deliver, or serve any food or beverage.
  • Every meal offered through the Service is created, described, priced, prepared, and served by an Organization and/or its food vendors, who are independent businesses and are not our agents, employees, or partners.
  • When you place an order, your purchase is a transaction between you and the Organization — not between you and MealDay. The Organization is the merchant of record for your order.
  • We do not supervise, direct, or control any Organization or vendor, and we make no promises about the quality, safety, legality, ingredients, or suitability of any food.

3. Eligibility and Accounts

You must be at least 18 years old and have the legal authority to make decisions (including dietary and health disclosures) for any child you add to your account. Accounts are for adults only; the Service is not directed to children, and children may not create accounts or place orders.

You are responsible for the accuracy of the information in your account, for maintaining the confidentiality of your credentials, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

4. Information About Your Children

The Service lets you create profiles for your children, including names, dates of birth, allergies, allergy severity, and dietary preferences. You represent and warrant that:

  • you are the parent or legal guardian of each child you add, or are otherwise authorized to provide their information;
  • all information you provide — especially allergy and dietary information — is accurate, complete, and kept up to date by you; and
  • you consent to our sharing of that information with the Organization(s) you order from and their staff and food vendors so they can fulfill orders and produce allergy and kitchen reports.

MealDay relies entirely on the information you enter. We have no ability to verify it, and we are not responsible for any consequence of information that is missing, outdated, or inaccurate.

5. Orders, Pricing, and Payment

Prices, menus, program schedules, order deadlines, and closure dates are set by each Organization and may change at any time. All amounts are charged in the currency shown at checkout. Payment is processed by Stripe on the Organization’s own payment account; MealDay does not receive or hold your funds (other than any platform service fee shown at checkout) and never stores your card details.

An order is confirmed only upon successful payment. Where a service and processing fee is shown at checkout, it is part of the total you agree to pay and is non-refundable except where required by law.

If you choose to save a payment method at checkout, Stripe stores it on the Organization’s payment account so you can reuse it for future orders with that Organization. Saved payment methods belong to your family account and are shared with every member of that family (for example, a co-parent), any of whom may use one to pay for an order they place. MealDay charges a saved payment method only for an order placed by a member of your family, either on the Service or through an AI assistant that member has connected to their MealDay account. Because the method is stored on the Organization’s own Stripe account, the Organization is responsible for any use of it outside the Service. When you connect an AI assistant, you authorize it to act on your behalf, including placing orders and — unless you turn that permission off when connecting — paying for them with your family’s saved payment methods; you are responsible for orders it places, and you can disconnect it at any time from your account settings. Each such charge is a one-time payment for that order; MealDay never initiates recurring or unscheduled charges. You can remove a saved payment method from the payment step at checkout, or by asking the Organization to remove it from their Stripe account.

6. Order Deadlines, Changes, and Cancellations

Organizations set ordering cutoffs so kitchens can plan and purchase food. Once a cutoff has passed, orders for the affected dates are final and generally cannot be changed or cancelled through the Service. Any change, cancellation, credit, or exception after a cutoff is entirely at the Organization’s discretion.

If an Organization closes, cancels a program day, changes a menu, or substitutes a meal, your remedy (if any) comes from the Organization under its own policies.

7. Refund Policy

Because your purchase is a transaction with the Organization, all refunds, credits, and adjustments are governed by the Organization’s own refund policy and are issued (or declined) by the Organization at its sole discretion, except where a refund is required by applicable law.

  • MealDay has no obligation to issue refundsand is not responsible for any Organization’s decision to grant or deny one.
  • Cancellations made through the Service before an order’s cutoff are handled per the Organization’s settings, which may provide a refund to your original payment method.
  • Missed meals — including absence, illness, schedule changes, or a child declining a meal — are not refundable by MealDay.
  • Platform service fees are non-refundable except where required by law or where the underlying charge is refunded in full through the Service.

For refund requests, contact the Organization you ordered from directly.

8. Food Safety and Allergen Disclaimer

If your child has a severe or life-threatening allergy, do not rely on this platform alone. You must communicate directly with the Organization and its kitchen before ordering, and you are solely responsible for deciding whether any meal is safe for your child.

Menu descriptions, ingredient lists, and allergen tags shown in the Service are provided by Organizations and their vendors. MealDay displays this information as received and does not review, test, audit, or verify it.

MealDay makes no representation, warranty, or guarantee of any kind that any meal is free of any allergen or ingredient, accurately labeled, prepared in an allergen-free environment, or protected from cross-contact or cross-contamination. Allergen information may be incomplete, outdated, or wrong, and recipes and suppliers may change without notice.

Allergy information you enter for a child is transmitted to the Organization as a convenience. Transmitting it does not guarantee that any Organization, kitchen, or vendor will read it, act on it, or accommodate it. Verifying that an Organization can safely feed your child is your responsibility and the Organization’s — never MealDay’s.

9. Assumption of Risk

You acknowledge that consuming food prepared by others carries inherent risks, including allergic reactions, intolerances, foodborne illness, and the presence of undeclared ingredients or foreign objects. To the fullest extent permitted by law, you knowingly and voluntarily assume all such risks for yourself and for each child on whose behalf you order, and you agree that MealDay is not liable for any illness, injury, allergic reaction, or death arising from food ordered through the Service.

10. Disputes with Organizations; Release

Any dispute about food, service, refunds, program access, conduct, or anything else arising between you and an Organization or vendor is solely between you and them. To the fullest extent permitted by law, you release MealDay and its owner, officers, employees, and agents from all claims, demands, and damages of every kind, known or unknown, arising out of or connected with any such dispute or with any act or omission of an Organization or vendor.

If you are a California resident, you waive California Civil Code §1542, which says: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”

11. Acceptable Use

You agree not to:

  • use the Service unlawfully, or to provide false information about yourself or a child;
  • access another family’s or Organization’s data, probe or breach security, or interfere with the Service’s operation;
  • scrape, copy, resell, or reverse engineer the Service, or use it to build a competing product;
  • initiate fraudulent chargebacks or abuse refund or coupon mechanisms.

We may suspend or terminate any account at any time, with or without notice, for conduct we reasonably believe violates these Terms or harms the Service, an Organization, or other users.

12. Intellectual Property

The Service, including its software, design, and content (other than content supplied by Organizations or by you), is owned by MealDay and protected by law. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose. No other rights are granted.

13. Third-Party Services

The Service depends on third-party providers, including Stripe for payments. Your use of those services may be subject to their own terms, and we are not responsible for their acts, omissions, or outages.

14. Disclaimer of Warranties; Limitation of Liability

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted or error-free operation.

To the fullest extent permitted by law: (a) MealDay will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or personal injury (including illness, allergic reaction, or death) arising from food or from the acts or omissions of any Organization or vendor; and (b) MealDay’s total aggregate liability for all claims relating to the Service will not exceed the greater of US$100 or the platform service fees you paid to MealDay in the twelve (12) months before the claim arose. Amounts you paid to an Organization for meals are not amounts paid to MealDay.

Some jurisdictions do not allow certain exclusions or limitations; in those jurisdictions, our liability is limited to the smallest extent permitted by law. The limitations in this section apply regardless of the theory of liability and even if a remedy fails of its essential purpose.

15. Indemnification

You agree to defend, indemnify, and hold harmless MealDay and its owner, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service; (b) information you provide, including allergy and dietary information; (c) your violation of these Terms or of any law; or (d) any dispute between you and an Organization or vendor.

16. Dispute Resolution — Binding Arbitration and Class Action Waiver

Except for small-claims matters and requests for injunctive relief, any dispute between you and MealDay arising out of or relating to the Service or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will be conducted in English, and judgment on the award may be entered in any court of competent jurisdiction.

You and MealDay each waive the right to a jury trial and the right to participate in a class action, class arbitration, or other representative proceeding. Disputes may be brought only on an individual basis.

You may opt out of this arbitration provision by emailing mealdayapp@gmail.com within 30 days of first accepting these Terms, with your name and account email, stating that you opt out of arbitration. Any claim must be filed within one (1) year after it arises, or it is permanently barred, to the extent permitted by law.

17. Governing Law

These Terms are governed by the laws of the State of Connecticut, without regard to conflict-of-law rules. Subject to Section 16, any court proceeding will be brought exclusively in the state or federal courts located in Connecticut, and you consent to their jurisdiction.

18. Changes; Termination; General

We may modify the Service or these Terms at any time. Material changes take effect when posted with an updated effective date; continued use of the Service after that date constitutes acceptance. We may discontinue the Service, or your access to it, at any time. Sections that by their nature should survive termination (including Sections 8–17) survive.

If any provision of these Terms is held unenforceable, it will be enforced to the maximum extent permissible and the remainder will stay in effect. These Terms, together with the Privacy Policy, are the entire agreement between you and MealDay regarding the Service. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them freely.
